Weed continues to get a chilly reception in Ocean Shores

City could get one more retail pot shop

Marijuana producers, marijuana processors and marijuana cooperatives, even if licensed by the Washington State Liquor and Cannabis Board, would not be permitted to operate within city limits of Ocean Shores under a new pair of ordinances proposed by a City Council committee studying the issue.

While the city has been preventing any new marijuana business from operating under an existing moratorium, the new ordinances would allow new recreational/retail stores like the existing Have a Heart business under some conditions. But the council, by a 4-3 vote, amended the language to allow only one additional retail business.

Producers, marijuana processors, or marijuana cooperatives cannot “operate as an accessory to a primary use or as a home occupation,” under the new ordinances. Also, no delivery services will be allowed in city limits.

Marijuana retailers must be licensed by the Washington State Liquor and Cannabis Board and are permitted only in the B-1 zones. Under the new language, marijuana retailer and retail outlets are permitted “in the mixed commercial and hotel area defined solely as Ocean Shores Boulevard between Damon Road and the 600 block and sensitive use buffers.”

“Marijuana retailers shall not operate as an accessory to a primary use or as a home occupation,” the new ordinance language states.

Also, the ordinances establish buffer zones where marijuana businesses must not be located within certain distances from schools, parks and other such businesses.

“If any marijuana odor can still be smelled from any abutting use or property, the marijuana retailer may be fined a daily fine and required by the city to move to another location,” the new ordinances state.

The existing moratorium expires in late March, so the city has until then to complete action on the two new ordinances. The state currently has designated the city of Ocean Shores to have one more retail marijuana license, which likely would be impacted by the new ordinances.
