Aberdeen man charged with shooting brother cleared

Now faces only one charge of unlawful possession of a firearm

An Aberdeen man initially charged with third degree assault involving domestic violence in the shooting of his brother in August has had that charged dropped.

Lloyd Steven Nunez instead has been charged with unlawful possession of a firearm (he has a prior felony conviction) with a minimum term of 1-3 months and a maximum of five years and a $5,000 fine. He will also have to register annually as a firearm offender and pay court costs, according to court documents.

Aberdeen Police were called to a home in the 400 block of Pacific Avenue Aug. 16 for a report that shots had been fired. Based on the evidence at the scene, investigators believed Nunez had shot his brother. But, according to court documents, the brother, who survived, was able to relay to prosecutors that it was not Nunez who pulled the trigger.

Nunez will face sentencing on the gun charge Jan. 8.
